Comunicado de prensa Falta de ambición de la Comisión en su respuesta a la primera Iniciativa
Ciudadana Europea

(Bruselas 19 de marzo) La Comisión Europea (CE) ha publicado hoy una comunicación
exponiendo su respuesta oficial a la primera Iniciativa Ciudadana Europea (ICE) exitosa que
pide “incluir en la ley europea del derecho humano al agua al saneamiento”. La Comisión
Europea reafirma la importancia del derecho humano al agua y al saneamiento y explicita su
importancia como un bien público y un valor fundamental. También reafirma que “el agua no
es una mercancía”. Sin embargo, se queda ahí.
“A la Comisión Europea le falta una verdadera ambición en su reacción que refleje
adecuadamente las expectativas de los 1,9 millones de personas que han firmado,” declara
Jan Willem Goudriaan, vicepresidente de la ICE Right2Water (Derecho al agua, en
castellano). “Lamento que no haya ninguna propuesta para legislación que reconozca el
derecho humano al agua”.
La ICE también pidió un compromiso legal de que no haya Iniciativas de la UE que busquen
liberalizar servicios de agua y saneamiento. Pero el comunicado no dice nada al respecto.
Sin duda, nos alegramos de que el apoyo de ciudadanos por la ICE haya llevado a la
exclusión de servicios de agua y sanitación de la Directiva de concesiones. Sin embargo, en
el comunicado de hoy, la Comisión no se ha comprometido a excluir explícitamente estos
servicios de las negociaciones comerciales, como las del Acuerdo de Libre Comercio
Transatlántico (TTIP).

No obstante, consideramos como positivos algunos aspectos de la respuesta de la
Comisión: por ejemplo el reconocimiento de que la provisión de servicios de agua es
generalmente la responsabilidad de autoridades locales que son más cercanas a la
ciudadanía. Esto subraya la tendencia hacia la remunicipalización a lo ancho de Europa, lo
cual es, según el comunicado, la garantía más segura de la exclusión de agua del
reglamento del mercado interno, una demanda clave de la ICE.

Nos alegamos también de que la Comisión se haya comprometido a promover el acceso
universal al agua al saneamiento en sus políticas de desarrollo y en las iniciativas varias con
este fin, incluyendo la promoción de partenariados público-público (PuPs).

Esperamos que el rexamen de la Directiva marco del agua y la Directiva del agua potable
sean una oportunidad de realizar el derecho humano al agua a la sanitación en la UE. El
Comité de Ciudadanos espera que nos tomen en cuenta como la principal parte interesada.
Pediremos a los partidos políticos, y a sus candidatos a la Presidencia de la CE, que se
comprometen a proponer legislación con el fin de implementar el derecho humano al agua y
a la sanitación, y de prevenir la liberalización de servicios de agua y de sanitación, en la UE
y más allá. Esto será un tema clave para las elecciones europeas en mayo 2014.

La Commission manque d’ambition dans sa réponse à la première Initiative
Européenne

La Commission européenne (CE) a publié aujourd'hui dans une Communication sa réponse officielle à la première Initiative Citoyenne européenne (ICE) réussie, initiative qui l'invitait à « mettre en œuvre le droit humain à l'eau et à l'assainissement dans la législation européenne ». Dans sa Communication, la Commission européenne rappelle l'importance du droit humain à l'eau et à l'assainissement, affirme l'importance de l'eau comme un bien public et comme une valeur fondamentale et répète que « l'eau n'est pas une marchandise ».

Cependant, cela s’arrête là.
« La réaction de la Commission européenne manque d’une réelle ambition à répondre de
manière appropriée aux attentes de 1,9 million de personnes », explique Jan Willem
Goudriaan, vice-président de l’ICE Right2Water. « Je regrette qu'il n'y ait pas de proposition
de loi reconnaissant le droit humain à l'eau ».

L'ICE a également demandé un engagement juridique à ce qu’il n’y ait pas d’initiatives de
l'UE visant à libéraliser les services d'eau et d'assainissement . Mais il n'y a rien dans la
Communication à ce sujet. Nous nous réjouissons bien sûr du fait que le soutien de la
population pour notre ICE ait conduit à l'exclusion des services d'eau et d'assainissement de
la directive sur les concessions. Toutefois , la Communication de la Commission ne s'engage
pas à exclure explicitement ces services des négociations commerciales telles que le
Partenariat Transatlantique de Commerce et d’Investissement (TTIP) .

Néanmoins, il y a certains aspects de la réponse de la Commission Européenne que nous
considérons comme positifs. Par exemple, la reconnaissance du fait que la fourniture des
services d’eau soit généralement la responsabilité des autorités locales qui sont les plus
proches des citoyens . Cela confirme la tendance à la remunicipalisation à travers l'Europe
ce qui, selon la communication, est le moyen le plus sûr pour que l'eau soit gardée hors des
règles du marché intérieur, ce qui est l'une des principales exigences de l'ICE.

Nous saluons également l'engagement de la Commission à promouvoir l'accès universel à
l'eau et à l'assainissement dans ses politiques de développement et à promouvoir les
partenariats public-public.
Nous nous attendons à ce que la révision de la directive cadre sur l'eau (DCE) et la Directive
sur l'eau potable soit l'occasion de réaliser le droit humain à l'eau et à l'assainissement au
sein de l’'UE . Le Comité des citoyens entend être considéré comme un acteur majeur.

Commission lacks ambition in replying to first European Citizens’ Initiative

The European Commission (EC) published a Communication today that gives its official response to the first successful European Citizens’ Initiative (ECI) which called on the EC “to implement the human right to water and sanitation in European law.” In the Communication, the European Commission does recall the importance of the human right to water and sanitation and states the importance of water as a public good and fundamental value and that “water is not a Commercial product”. However, that’s as far as it goes.
“The reaction of the European Commission lacks any real ambition to respond appropriately
to the expectations of 1.9 million people” says Jan Willem Goudriaan, vice-president of the ECI
Right2Water. “I regret that there is no proposal for legislation recognising the human right to water.”
The ECI also asked for a legal commitment that there would be no EU initiatives to liberalise water and sanitation services. But there is nothing in the Communication on this. We certainly welcome the fact that the support of people for our ECI led to the exclusion of water and sanitation services from the concessions directive. However, the Commission’s Communication makes no commitment to explicitly exclude these services from trade negotiations such as the Transatlantic Trade and Investment Partnership (TTIP).
Nevertheless, there are aspects of the European Commission response that we do consider to be positive. For example, the recognition that the provision of water services is generally the
responsibility of local authorities which are closest to citizens. This confirms the trend towards
remunicipalisation across Europe which according to the communication is the safest way
for water to be kept out of the internal market rules, one of the main demands of the ECI.
We also welcome the commitment of the Commission to promote universal access to water and
sanitation in its development policies and to promote public-public partnerships.
We expect that the review of the Water Framework Directive (WFD) and the Drinking Water
Directive will be an opportunity to realise the human right to water and sanitation in the EU.

The Citizens’ Committee expects to be considered as a major stakeholder.
We will be asking the political parties and their candidates for President of the EC to commit to
proposing legislation to implement the human right to water and sanitation and not to liberalise
water and sanitation services in the EU and beyond. This will be important for the European
elections in May 2014.

Europe and the USA are in the midst of negotiating a huge trade deal -- the Transatlantic Trade & Investment Partnership or TTIP. The TTIP isn’t just a simple trade treaty, it’s actually a huge corporate power grab affecting literally millions of European and American citizens.
The EU is about to launch a big consultation across Europe asking organisations and everyday people for their views. There’s a real danger that the loudest voices could be coming from the very corporations that stand to benefit from such a system.
The consultation starts really soon, so we don’t have long to prove that it’s people power that counts, not corporate power.

Hva har Dayton-avtalen for Bosnia Herzegovina, Rambouillet-avtalen for rest-Jugoslavia, Pinochets Chile og Troikaen (EU-kommisjonen/EUs sentralbank/Det internasjonale pengefondet) felles?


Hellas
For å ta det siste først: Privatisering av statlige selskaper er en del av programmet Hellas må gjennomføre for å få kriselån fra EU og Det internasjonale pengefondet (IMF). Selskaper som forventes solgt er Pireus Havn, flyplasser og de to største vannverkene (Athen og Thessaloniki). Mens havnearbeiderne streiker, arbeider innbyggerne i Tessaloniki for å samle økonomisk støtte til å kjøpe sitt eget vannverk, som skal selges til høystbydende. Norge er pinlig nok med i budrunden som medeier i Veolia.


Chile
Pinochet endret lovverket i Chile i markedsliberalistisk retning. Lovverket ble slik utformet at det er tilnærmet umulig for senere regjeringer å gjøre om på denne markeds- liberalistiske politikken.


Jugoslavia
Både Dayton-avtalen og Rambouillet-avtalen stilte krav om markedsliberalisering og salg av offentlige selskaper. Ikke å undres over at Milosovich vegret seg for å undertegne Rambouillet-avtalen. Det ville vært identisk med landsforræderi.  Alternativet var at NATO bombet landet til lydighet. For Milosovich sto valget mellom pest og kolera. Og vi kjenner resultatet. Straks bombingen var overstått, ble de statlige selskapene lagt ut for salg i et internasjonalt marked.

I Bosnia og Herzegovinas grunnlov, diktert i Dayton-avtalen, kan vi lese at myndighetene skal arbeide for økonomisk vekst, beskytte privat eiendom og fremme markedsøkonomi.


Samvirker/kooperativer
Spesielt for Jugoslavia, før Dayton-avtalen, var omfanget av kooperativer eller samvirker. Tradisjonelt har kooperativer hatt en annen målsetting enn å drive næringsvirksomhet med tanke på profitt. I stedet for konkurranse, utmerket kooperativene seg med samarbeid. Kooperativene kunne ikke selges i et internasjonalt marked, siden de var eiet av flere i fellesskap – og i en forstand allerede var private. Løsningen ble å gjøre dem om til statlige selskaper. Deretter kunne de privatiseres i markedsliberalistisk forstand og tilbys i et internasjonalt marked. Er det konturene av denne fremgangsmåten vi værer også i Norge?


Norge og Samvirkeloven
I 2008 trådte Lov om samvirkeforetak i kraft. Før den tid var ikke samvirkene regulert ved lov. De ble heller ikke ansett for å drive alminnelig næringsvirksomhet, snarere var de en sosial organisering av et samarbeid. Inntil 2013 hadde vi også andelslag, men disse må heretter organiseres etter Lov om samvirkeforetak.

Samvirkeloven skiller seg ikke vesentlig fra Lov om aksjeselskap. Både samvirker og aksjeselskap regnes for å ha profittformål. Den sosiale eller ideelle tanken bak samvirkene er fraværende i loven.  De i utgangspunktet sosiale tiltakene, som var organisert som andelslag eller samvirker, skal heretter likebehandles med selskaper som kun har profitt som formål.


Offentlig sektor
Bedriftsøkonomien har, som kjent, fått innpass i offentlig sektor gjennom fenomenet New Public Management. Offentlige virksomheter organiseres også i foretak, så som Kommunale foretak, Interkommunale selskaper eller aksjeselskaper.

Omorganiseringen av fellesskapets verdier til foretak har gjort virksomhetene mer utsatt for privatisering. Spesielt der aksjeselskap er valgt, kan man foreta en gradvis privatisering gjennom salg av aksjer.
 
Vannforsyningen er i det store og hele både bygget opp og betalt av abonnentene. Der kommunene har organisert vannforsyningen etter en eller annen foretakslov, er eierskapet overført fra abonnentene til kommunen. De er altså blitt offentlig eiendom.

Offentlig virksomhet er ikke hva det var. Det regnes ikke lenger som vårt felleseie, men ansees som en hemsko for økonomisk utvikling. Credoet er: la private overta!

Det er påkrevet å skape en ny, uangripelig, offentlig sektor. Det er egentlig bare mulig om den defineres som privat. Samvirke er en slik privat løsning. Et samvirke er privat samtidig som det bærer det offentliges tradisjonelt positive trekk ved seg. Alternativet til kommunal vannforsyning under press for økonomisk liberalisering, er vannsamvirker.  Samvirkene åpner også for mer direkte demokratisk medvirkning. Det synes å være på høy tid.

2) I also use this opportunity to inform you that the workers and their union of the Thessaloniki Water Company (EYATH) and the broad coalition of social action groups will be organizing a local referendum against the privatization of the company.
This referendum will take place 18 May.
It is a self-organized referendum and the costs for the union and the supporting groups are enormous.
We will shortly be asking for your support but already you might want to consider sending someone of your organization (in the days before and on 18 May) to observe and assist in the referendum. Polling stations will need to be staffed, leaflets distributed, media informed…

Det var en gang ...

Inntil 2001 var norsk lovgivning i overensstemmelse med de øvrige europeiske land når det gjaldt eiendomsrett til vann: Ingen eiet vannet, bare grunnen over eller under vannet. Men i 2001 innførte Norge, som eneste land i Europa, grunneiers eiendomsrett til vannressurser på egen eiendom (Vannressursloven).

Almen vannforsyning kan imidlertid skaffe seg rett til vannuttak, enten ved avtale med grunneier eller ved ekspropriasjon. Det virker tilsynelatende rett og rimelig.

Drikkevannsforsyning i regi av kommunen var en gang et tiltak for å bedre den almene velferd, helse- og renslighetstilstanden.  Men kommunen har aldri hatt plikt til å levere vann og den har det heller ikke i dag.


Først privat, deretter kommunalt
De fleste vannforsyningene i Norge er etablert av brukerne selv. Etter hvert ble driften av mange private vannverk overtatt av kommunen, spesielt i og rundt byene. De ble slått sammen til større enheter. I det store og hele var det uansett abonnentene som betalte driften. Kommunen hverken bruker penger, eller tar ut fortjeneste på vannforsyningen.


Plan- og bygningsloven har i decennier krevet at ny bebyggelse skal kobles til kommunal ledning, om det finnes en slik i nærheten. I 2010 kom det en endring, som gjør at også eksisterende bebyggelse kan kreves koble til kommunal ledning, om det legges en slik i nærheten.

Men som nevnt, kommunen har fremdeles ingen plikt til å levere vann. Den kan bare kreve at du skal koble deg til kommunal ledning. Kommunen kan imidlertid gi dispensasjon fra kravet, men det er det opp til kommunen å avgjøre.

I 2012 fikk vi en lov om kommunalt eierskap til vann- og avløpsanlegg. Det vil si at vannverk og ledninger skal eies av kommunen og at ingen kan selge private anlegg til andre enn kommunen. Det høres tilsynelatende rett og rimelig ut.

Saken er imidlertid den at de såkalt kommunale vannverkene ikke var eiet av kommunene tidligere. De var abonnentenes eiendom, mens kommunen utelukkende sto for driften. Abonnentene betaler både etableringen av vannverkene, legging av ledninger og kostnader i forbindelse med driften, via kommunal vannavgift. Eventuelle lån, renter og avdrag betales av abonnentene, ikke kommunen. Overføringen av eierskapet til anleggene fra abonnentene til kommunen kan anses som et overgrep mot abonnentene, noe som med tiden vil vise seg å være svært alvorlig.


Kommunal hovedplan for vannforsyningen
Kommunene er pålagt å lage en hovedplan for vannforsyningen.  Men de er fremdeles ikke forpliktet til å levere vann.

Hovedplanen skal vise hvordan kommunen vil bygge ut vannforsyningen, sikre vannkildene, sørge for at drikkevannsforskriftens krav til kvalitet oppfylles og helst sørge for reservevannforsyning. Det siste innfris gjerne ved at man kobler seg til nabokommunens vannforsyning eller lignende. Dette er tilsynelatende rett og rimelig. Bortsett fra at kommunen ikke er forpliktet til å levere vann.

Kommunene er pliktoppfyllende og legger storstilte planer for ledninger til nye boligområder, men også til områder som har egen vannforsyning. Noen av de private vannverkene har problemer med å oppfylle de strenge kravene i Drikkevannsforskriften og er kanskje tilfreds med å slippe ansvaret. Andre driver eksemplarisk, mens noen/de fleste ikke har krav til godkjenning, fordi de leverer vann til færre enn 20 husstander. Men i kommunenes hovedplaner skal alle med.


FN
I regi av FNs økonomisk komite for Europa ved divisjon for økonomisk samarbeid og integrasjon, stilles det krav til nasjonal målsetting og rapportering av rent vann. Det er tale om at alle, og det vil si hver minste brønn, skal ha krav til godkjenning. Det innebærer selvfølgelig at også vannverk med færre enn 20 abonnenter må godkjennes av Mattilsynet i henhold til Drikkevannsforskriften. Saken er tilsynelatende ute på høring (tilsynelatende, fordi det ikke er rom for diskusjon om målsettingene). Men det er altså ikke noe formelt vedtak ennå. Inntil videre skulle de små samvirkene være trygge for egen eksistens. Men den gang ei.


Krav med absurde utslag
Med referanse til Plan- og bygningsloven krever kommunene tilkobling til offentlig ledning. Kravet får iblant de mest absurde utslag.

Kommunen kan kreve tilkobling til kommunal ledning, men siden kommunen ikke er forpliktet til å levere vann, kan ikke kommunen kreve at du benytter deg av vannet. Du må betale tilkoblingsavgift og fast avgift, men du behøver ikke betale for vannforbruk, hvis du fremdeles benytter egen brønn eller vann fra eget vannverk.

I Søndre Land har de glemt hva som var årsaken til at kommunene i sin tid grep tak i vannforsyningen; nemlig å sørge for bedre helse og velferd for innbyggerne. Kommunens eget vannverk driver på dispensasjon fra Mattilsynet. Vannverket oppfyller ikke kravene i Drikkevannsforskriften.

Allikevel krever kommunen at 7 andelsvannverk, der de som har krav til godkjenning fra Mattilsynet - og er godkjent -, skal kobles til det kommunale nettet, som ikke levere godkjent kvalitet.

Hvis ikke dette skulle vekke mistanke om at målsettingen med kommunalt vann er en annen enn helse og velferd, må man være spesielt naiv.

I en rapport utarbeidet for Kommunal- og moderniserings-departementet («Kommunal virksomhet i lys av EØS-avtalens statsstøtteregler») kommer det frem at ‘kommunal egenregi’, det vil si at vannforsyningen drives av teknisk etat og ikke et foretak, allikevel er å anse for foretaksvirksomhet i EU/EØS-rettslig forstand.

Det utgjør ingen forskjell om kommunen driver vannforsyningen i teknisk etat eller har etablert et kommunalt foretak (KF), et aksjeselskap eller interkommunalt selskap. Uansett er det økonomisk virksomhet. Kommunal egenregi er det samme som foretak i EØS-rettslig forstand. Dermed inntrer EUs krav om konkurranseutsetting i begge tilfeller.


De transnasjonale vannselskapene
Det er lite interessant for de transnasjonale selskapene å drifte små vannforsyninger. Derfor øver de et sterkt press på lovgivere, spesielt innad i EU, for å få en lovgivning som sørger for at vannforsyningsområdene blir så store som mulig.

Selskapenes lobbyvirksomhet er svært omfattende og griper inn på nær sagt ethvert område; om det gjelder krav til drikkevannskvalitet, klausuleringer, barrierer eller rense-teknologi. Alt med virkning også for Norge gjennom EØS-avtalen.

Norge er interessant, ikke fordi vi er så mange (vi er totalt bare på størrelse med en europeisk storby), men fordi landet er så rikt på vann og fordi vannkvaliteten stort sett er ypperlig. Eksport av vann er en sannsynlig fremtid. Den første ledningen er allerede lagt til Sverige. Men en eventuell eksport må ikke bli kommersiell, slik det er gått med strømmen. Eksport av humanitære grunner er noe helt annet.


Manglende lokal politisk motstand
Det som kan være overraskende er at det er så lite motstand blant lokale politikere og i lokal administrasjon for denne politikken.

At det er motstand i befolkningen, ikke minst blant dem som tvinges bort fra egen vannforsyning og over på kommunal ledning, er derimot et faktum.

Tiden begynner å bli knapp, hvis vi vil unngå at drikkevannet lider samme skjebne som strømforsyningen.

Vi må kreve at de kommunale vannverkene skal fortsette å tilhøre abonnentene.

Og vi kan alle være med å slå ring om de vannverk som fremdeles er organisert som samvirker, men som kommuner over hele landet ønsker å ta over med tvang.

Below a letter to Suez Environment, the French company that is part of the consortium seeking to acquire Thessaloniki Water Company. It is part of the great campaign our colleagues are fighting.
As you know the workers of Thessaloniki Water Company (EYATH) have been opposing the privatisation of their company. That privatisation is part of the conditions that the Troika set for Greece in return for the bail-outs it received. They are supported in their campaign by a broad section of Greek society and recent opinion polls show 3/4 of the people are against in Thessaloniki. EPSU has also been supporting the union and the campaign as have many other organisations part of the European Water Movement.
The Greek coaliton is demanding a referendum to coincide with the municipal elections in March. When definite they can use all the help they need.
Recently a high level representative of Suez gave a press conference in Thessaloniki meeting with a selected group of journalists (several of which work for the media empire that is part of the holding company that is bidding for the contract). The Greek water movement was not invited. They replied therefore in the media to statements made by Suez during the press conference:

Dear Diane,

Let us please clarify that what follows is based on what you said and answered during your recent Press Conference in Thessaloniki, as it has been reported by the journalists and media that were present.
Despite the democratic traditions of your home country and in stark contrast to your saying that Suez will definitely take into account the citizens’ public feeling and vision, the fact that no invitation was provisioned for interested citizens and not all interested journalists were invited, can only be judged negatively. It also stood in contrast to your invitation, on behalf of Suez, to elected members of the city council to become Members in the company’s new BoD. One of those present could have asked a clarifying question as to what rights such a membership would mean apart from providing a false feeling of public participation and an implication of transparency. Unfortunately no such question was posed by the reporters in the room, some of which are in the payroll of your partner in the TAIPED (HRADF) tender for the acquisition of the 51% shares  of Thessaloniki water Company (EYATH).
Reading your resume we were informed that in 1993 you took a managerial positionand then a promotion in the Aguas Argentinas (Buenos Aires) which was privatized in1993 in the midst of the economic crisis in Argentina and remunicipallized in 2006.Argentina, as you note in your CV,  was for you “a great experience providing the opportunity to discover other ways of thinking, professionally and personally“.
You mentioned that the price of water shall be set by an independent regulatory authority. The Greek WRA is nothing more than the Special Secretariat for Water (an old service within the Ministry of Environment, Energy and Climate Change) that has hastily been upgraded to the status of an independent Authority just after the announcement of the imminent privatization of EYDAP (Athens water company) and EYATH. Such a service may remind you of its respective one in Argentina which as per the report of Alcázar, L.; Abdala, A.; Shirley, M Washington D.C.: The World Bank. Retrieved 2008-04-16 the local WRA “was lacking in experience as it was created during the privatization” and its “decisions were not taken into consideration”. The fact that AA was in 1997, while the crisis raged in the country, granted a concession contract with very generous terms that authorized it to demand dollars at the old 1:1 exchange rate after the peso devaluation, despite the abysmal international market value of the former (Solanes, Miguel (2006) only underlines the local WRA efficiency and abilities. “Efficiency, Equity, and Liberalisation of Water Services in Buenos Aires, Argentina”. Industry, Services & Trade (OECD).
On top, in 2010 ICSID awarded that the Argentina Government decision, disallowing raises in water prices when the value of the ARS was precipitating, wronged private water operators and ordered a compensation. The privates declared that they will go after a USD 1,2 billion compensation. Eventually,  are the decisions of the regulatory authorities concerning  the price of water but also the keeping of contractualobligations or other issues “respected“, as you stated in Thessaloniki, or can their existence, in several cases, become just a bureaucratic alibi  facilitating corruption and being useful for the legalization of private monopolies under the consent of international organizations such as those that demand privatization in the first place?(1)
You set as one of Suez’ s main priorities in Thessaloniki the protection of the environment and – among others – the “reintroduction of quality in the Thermaikos Bay”. We sincerely hope so, as in Chile, Suez has been forced to pay a compensation of USD 5 billion for the “unpleasant odors” emitted from its waste water treatment plants. (research by the PSIRU team of the University of Greenwich).
Your pleasant promise for annual investments of € 25 and up to € 50 million on infrastructure that will remain property of ΕΥΑΤΗ Infrastructure S.A. definitely sets Suez among the foremost non-profit charity organizations worldwide, as the net profits of ΕΥΑΤΗ amount to ca € 18 million. Unless, of course, the price for water is somehow going to be “readjusted” so as to cover for the investments and the reasonable profit of the shareholders-investors, in which case the investments will have been paid by the good and, you shall hope, overgenerous citizens of Thessaloniki.
As a report (2009 PSIRU of the University of Greenwich) stated, water infrastructure investments in France are subsidized mainly by the public sector whereas only 12% on the average is paid by private water companies. How come important investments that have not been realized in France will be realized in Greece?
Could this be the reason why Paris, Brest, Grenoble,  Cherbourg,  Varages, Durance-Luberon, Castres retook water services under municipal control and why others (Toulouse, Ile-de-France, Montbeliard, Bordeaux, Lille) are eager to follow in the same path?
But even if such investments are to be made how is Suez going to pay for them?
The SUEZ profile shows liabilities amounting to € 19.777 million with assets of € 6.859 million. As assets include € 3.264 of goodwill while another € 4.060 million amount to other intangibles, then SUEZ turns negative (€ -465 million). For the last four years SUEZ shows only losses: € 2.281 million on 2009, € 1.158 million on 2010, € 1.205 million on 2011 and € 1.314 million on 2012. (2)
On the other hand, “small” ΕΥΑΤΗ (whose share price is overrated, as you stated), showed in 2012: profits of € 24 million euro (€ 18 million net), ready cash of € 33 million (today € 50 million according to latest information), and equity capital € 135 million on an annual income of € 74 million. Its stock market value is 220 million euro (according to the annual financial report of 2012).
Perhaps one should leave the theories about better management by the private sector aside until at least this picture is reversed.
You stated that SUEZ acquiring the EYATH shares will lead to 4.000 (!) new job opportunities, in a work environment which, for the last three years, has been pulverizing job positions in a terrifying pace and which shows no sign of changing in the near future.  From the date EYATH stopped being a public service and turned to an S.A. (with SUEZ, later, obtaining in 2006 5,46% of its shares) its personnel has been reduced from ca 700 to 235 today as job positions were not replenished afterretirement. By which viable investment plan and organization chart will recruitment of this order be needed to operate EYATH given the fixed number of “clients” and if you maintain the price per cubic meter at current levels? (In any case, the company at present, has only seven drivers for its 80 vehicles and employs only eleven plumbers on a network of some 2.330 km length and some 510.000 customers/hydrometers). As for prices, since 2001 there have been increases almost threefold. Still, you wondered whether the current water price of ΕΥAΤΗ can keep the company viable.
The referendum, you said, “may be important yet on the other hand, it is a political action”. Indeed. Such a referendum led to the citizens of Berlin being informed of the secret terms included in the concession contract by which their municipal water company had been given to Veolia and RWE and tariffs kept increasing; it was through this political action that these terms were made public and then the citizens started to struggle in order to reclaim the water service for the public sector. It was again such a referendum in Italy when 95,4% voted against the privatization of water services and the idea of profit out of water and as we say in Greece for our neighbors, since Greeks and Italians are “una faccia, una razza” it can definitely be such a referendum that will voice the will of the Greek people, the majority of whom are against the privatization of the monopoly of water. (3)
You talked about misunderstandings; you said that “water is not going to be privatized, we will just accomplish a public-private partnership”. We cannot feel at ease: it was such a partnership in Berlin that led to ever increasing water prices and loss of social control.
You said that “the worst thing for us is to be in a country that does not respect the law”. We agree. We would like therefore to inform you, in case you don’t know, that, according to Eleytherotypia mewspaper (4) , there is an ongoing investigation ordered by the Thessaloniki District Attorney for Corruption Argyris Demopoulos, concerning amounts of more than € 100 million,  part of which is coming from the EU Cohesion Fund, for projects that run till 2016 that, if are not to be paid for by the investor, are to be illegally spent for the profit of a private company (Greece has been penalized in the past for similar reasons), on the condition that  privatization occurs before that date. As per the report, an important parameter of the investigation is that HRADF is to produce the draft of the concession contract , to investigate exactly what is contained therein, in order to correlate the use of said infrastructure to the terms agreed.
Of course there is still pending the decision of the Council of State on the legality of the transfer of the ΕΥΑΤΗ shares to HRADF. What we as citizens (and presumably you as well) find absolutely unacceptable, is cases where the Constitution and the decisions of Supreme Courts  are not respected by all parts.
We assume that your personal presence in Thessaloniki despite your high position of Vice President, is indicative of the great interest of the company you represent to acquire EYATH as “springboard” for the Balkan market. This we definitely believe is so. Still we would advise you to keep in mind that the remunicipalization trend is already on the way even in the Balkan area.(5)

Times have changed since then, but we’d like to remind you of a historical fact: During the fire that destroyed Thessaloniki in 1917, the water supply company, one of French interests at the time, refused to distribute water as it needed it to supply the Entente forces then stationed in the area. In Hungary, even in towns where the water supply has been privatized, the investments are funded by the central administration. Van het Europees Parlement hebben we de link ontvangen via welke belangstellenden zich kunnen registreren om de openbare hoorzitting van ons Europees burgerinitiatief (EBI) bij te wonen. De hoorzitting vindt plaats op 17 februari van 15.00 uur tot 18.30 uur in het Europees Parlement (EP). Dit is de laatste etappe in de lange weg van ons EBI. Na de hoorzitting zal de Europese Commissie een besluit nemen of ze onze voorstellen overneemt en omzet in wetgeving.
Registreren is noodzakelijk om de hoorzitting bij te wonen via : http://www.opinio.europarl.europa.eu/opinio/s?s=secured_right2water . Registratie is mogelijk tot 7 februari, 13.00 uur(!), of tot de zaal vol is dus wees er snel bij!
Laat ons s.v.p. via een reply-mailtje weten of je komt.

Mocht je niet in staat zijn om naar Brussel af te reizen op 17 februari, dan bestaat de mogelijkheid om de hoorzitting te volgen via webstream. Ook is het mogelijk deel te nemen aan het debat via Twitter en Facebook. Hashtag en webadres volgen binnenkort.

Graag rekenen we op jullie steun en een grote aanhang op 17 februari in het EP.

Am primit link-ul pentru înregistrarea la audierea de la Parlamentul European www.right2water.eu din 17 februarie, ora 15.00. Acesta este ultimul pas public al campaniei înaintea acțiunilor Comisiei Europene cu privire la ICE. Vă rugăm să nu așteptați pentru a vă organiza călătoria, dacă planificați să veniți la Bruxelles pentru a participa la audiere, dacă nu sunteți în măsură să faceți acest lucru, dezbaterea va fi pe web și veți putea participa prin intermediul Facebook și Tweeter. În zilele următoare vă vom face cunoscute hashtag-urile și adresa exactă. Acum, mai mult ca niciodată avem nevoie de sprijinul dumneavoastră, oriunde vă aflați!

Vážení příznivci kampaně Voda je lidské právo,

obdrželi jsme webový odkaz pro registraci na slyšení do Evropského parlamentu ohledně kampaně www.right2water.eu  - 17. února od 15. hodin. Toto je poslední veřejný krok kampaně, než Evropská Komise začne ve věci Evropské občanské iniciativy konat. Pokud máte v úmyslu přijet do Bruselu se zúčastnit, prosím, neváhejte naplánovat vaši cestu co nejdříve. Pokud  nejste schopni účastnit se osobně, můžete se zapojit přes Facebook a Twitter, debata bude živě vysílána přes internet - v nejbližších dnech vám dáme vědět odkazy a přesnou adresu. Nyní více než kdy jindy potřebujeme vaši podporu, ať se nacházíte kdekoliv!
